“Woman Battles Hospital Over Husband’s Care Rights”

Dorothy Cook dedicatedly cared for her husband, Melvin, for 49 years after he was diagnosed with a rare brain disease. However, she faced challenges when a doctor refused to discharge him from the hospital due to the absence of a power of attorney document.

Power of attorney is a legal instrument that authorizes a trusted individual to make financial, property, or health decisions on behalf of another person. Dorothy, a 68-year-old from Bristol, had transitioned from being an occupational psychologist running her own business for 27 years to becoming a full-time carer for Melvin, who suffered from ataxia, a progressive brain and neurological disorder affecting mobility and communication.

During a hospital stay in March 2025, a doctor deemed Melvin lacking mental capacity, preventing his discharge. Dorothy believed this assessment was due to Melvin’s communication challenges rather than actual capacity issues, but as she was not present during the evaluation, she couldn’t assist in clarifying his condition.

Ultimately, Dorothy demonstrated her capability to care for Melvin effectively, allowing his discharge. Had she failed to prove this, the hospital team could have overridden her decisions legally. Melvin, a former engineer involved in the Concorde project, had shown symptoms of ataxia 17 years prior, prompting Dorothy to quit her job and focus on his full-time care.

Sadly, Melvin passed away at 78 in June 2025, but Dorothy is now advocating for power of attorney awareness, especially on the inaugural nationwide Power of Attorney Day. She emphasized the importance of having this legal document in place to avoid the distressing experiences she and Melvin encountered.

Post Melvin’s discharge, Dorothy arranged for power of attorney and encourages others to do the same, sharing her personal journey of navigating this process independently rather than seeking legal assistance. Carers UK and Standard Life have united to launch the UK’s first Power of Attorney Day, aiming to address the low 8% of adults with an active power of attorney and the 46% who do not prioritize it despite aging.

Helen Walker, Carers UK’s Chief Executive, emphasized the unpredictability of life events and urged carers to discuss and establish power of attorney before its urgent need arises. Similarly, Claire Hawkins, Standard Life’s Director of Corporate Affairs, highlighted the document’s critical role in safeguarding finances and ensuring prompt access to essential resources during crises.
